Please read these terms carefully before using the Sansthas platform.
This Terms of Use ("Terms of Use") constitutes a legally binding agreement between Ethneom Ventures (hereinafter referred to as "Sansthas", "Platform Owner", "we", "us" or "our") and you (hereinafter referred to as "User", "you" or "your"). For the purposes of these Terms, "User" shall include any organization including a trust, society, NGO, alumni association, fan club, community, or other member-based or charitable entity registered on the Platform (each a "Client Organization" or "Tenant"); and any individual accessing or using the Platform including members, employees, volunteers, donors, contributors, or affiliates of such Client Organization ("End Users"). These Terms govern your use of the website www.sansthas.com, all applications, dashboards, APIs, software, and services, as well as all features, content, and functionalities (collectively, the "Platform"). The Platform is a Software-as-a-Service (SaaS) infrastructure enabling Client Organizations to create and manage independent digital environments ("Tenant Platforms"). This document is an electronic record under the Information Technology Act, 2000 and constitutes a valid contract without physical or digital signatures.
By accessing, registering, or using the Platform in any manner, you agree to be bound by these Terms and all other operating rules and policies that may be published from time to time. Where a Client Organization enables access to End Users, such End Users shall also be bound by these Terms. If you do not agree with these Terms, you must immediately discontinue use of the Platform.
The Platform Owner is solely a technology service provider. Each Client Organization is an independent legal entity solely responsible for its own governance, administration, financial management, and transactions. The Platform Owner does not control or supervise Client Organizations and does not act as a trustee, agent, intermediary, employer, or partner to any User or entity.
Furthermore, the Platform Owner does not assume responsibility for any activities conducted by Users, and nothing in these Terms shall be deemed to create any partnership, joint venture, or agency relationship. Registration with or use of the Platform does not permit Users to create any obligations or liabilities on behalf of the Platform Owner. The Platform Owner is not an employer of any personnel registered by a Tenant and is not responsible for any employment-related liabilities or benefits.
The Platform is hosted on and operates through various third-party infrastructure and service providers, including but not limited to Cloud Service Providers, ISPs, Cloudflare, Sendgrid, Razorpay, Gupshup, Twilio, and Emergent. You acknowledge that the quality, availability, and reliability of the Platform are inherently dependent on these third-party operations. The Platform Owner does not control these third parties and shall not be held responsible or liable for any service disruptions, data delays, delivery failures, or security breaches resulting from the acts or omissions of these providers. Your interaction with any third-party services linked through the Platform is at your own risk and subject to the respective terms of those providers.
The Platform Owner is the sole and exclusive owner of the Platform and all associated Content, including original works developed through the expenditure of substantial time and money. This includes, without limitation, all copyrights, trademarks, service marks, logos, trade names, and other proprietary rights ("IP Rights") protected by Indian and international laws.
You are granted a limited, personal, non-exclusive, and non-transferable license to access and use the Platform strictly for its intended administrative purposes. You are expressly prohibited from modifying, reproducing, distributing, or creating derivative works of the Platform's software or content without prior written authorization. Any attempt to decipher, decompile, disassemble, or reverse engineer any part of the Platform is a material breach of these Terms and is strictly prohibited and may result in immediate termination of access.
Client Organizations and End Users remain the primary owners of the data, information, or content they upload to their respective Tenant Platforms ("User Submissions"). By using the Platform, you grant the Platform Owner a worldwide, royalty-free, sublicensable license to host, store, and process such content solely for the purpose of providing and improving the SaaS services. You represent and warrant that you possess all necessary rights to your User Submissions and that such content does not violate any third-party rights, privacy rights, or applicable laws.
The Platform may facilitate certain payments through integrations with third-party gateways; however, you acknowledge that all financial transactions are conducted directly between Users and Client Organizations. The Platform Owner acts merely as a technical facilitator and shall not be held responsible or liable for any matters pertaining to fund mismanagement, fraud, or misrepresentation by any party involved in a transaction.
Furthermore, the Platform Owner expressly disclaims any responsibility for handling refunds, disputes, or chargebacks, all of which must be resolved directly between the User and the respective Client Organization. Compliance with all applicable tax or financial laws, including the reporting and payment of any statutory dues arising from these transactions, remains the sole responsibility of the Users and Client Organizations.
As a condition of using the Platform, you solemnly pledge not to use the services for any purpose that is prohibited by these Terms of Use or applicable law. You are solely responsible for all activity conducted under your account, whether you are a Client Organization managing a Tenant Platform or an End User accessing it. You must abide by all local, state, national, and international laws, including specific regulations governing NGOs, trusts, and charitable financial management.
Specifically, you are strictly prohibited from using the Platform to facilitate, record, or engage in money laundering, illegal financial transactions, or the financing of any activities that threaten the sovereignty, integrity, or security of India (anti-national activities).
You shall not upload, post, or distribute any Content that is false, misleading, or designed to defraud any individual or entity. The Platform must not be used for any unlawful work, including but not limited to the distribution of obscene, defamatory, or hateful content, or any material that promotes bigotry, discrimination, or violence.
The Platform and all Content are provided on an "As Is" and "As Available" basis without warranties of any kind, express or implied. To the maximum extent permitted by law, the Platform Owner shall not be liable for any indirect, incidental, or consequential damages, including loss of profits, data, or revenue, arising from your use of the Platform or the failure of third-party services. In any event, the total aggregate liability of the Platform Owner shall be limited to INR 1,000.
You agree to defend, indemnify, and hold harmless the Platform Owner from any claims, losses, or expenses (including legal costs) resulting from your misuse of the Platform, violation of these Terms, or any dispute arising within your organization.
These Terms shall be interpreted and construed in accordance with the laws of India. The Courts of appropriate jurisdiction at Bangalore, Karnataka, India, shall have exclusive jurisdiction over any disputes arising under this agreement. Any cause of action arising out of or related to the Platform must commence within one (1) year after the cause of action arose, or it shall be forever barred.
We reserve the right, at our sole discretion, to modify or replace any of the Terms of Use or change the Platform features at any time. It is your responsibility to check the Terms periodically for changes, as continued use constitutes acceptance of those changes. We may also terminate your access to the Platform at any time, with or without cause or notice, which may result in the forfeiture of all information associated with your account.
